Terms of Service

1. Service Description

INX Technologies provides managed automation infrastructure services and website development services ("Services") to businesses and institutes. Our Services include:

  • Automation as a Service: Design, deployment, and management of automation systems including enquiry automation, email confirmation automation, workflow automation, and managed backend infrastructure.
  • One Site Website Development: Design and development of static, fast-loading business websites for professional online presence.

These Terms of Service ("Terms") govern your use of Services provided by INX Technologies, based in Patna, India.

2. Client Responsibilities

As a client of INX Technologies, you agree to:

  • Provide accurate and complete information necessary for the configuration of automation systems.
  • Obtain appropriate consent from your end users before their data is processed through our automation systems.
  • Ensure that the use of our Services complies with all applicable laws and regulations in your jurisdiction.
  • Promptly notify INX Technologies of any changes to your business operations that may affect the configured automation workflows.
  • Not use our Services for any unlawful, fraudulent, or harmful purpose.

3. Automation Limitations

While INX Technologies strives to provide reliable automation systems, clients acknowledge the following limitations:

  • Automation systems depend on third-party services (including email providers and APIs) that may experience downtime or changes outside our control.
  • Automation workflows are configured based on the information and requirements provided by the client. Inaccurate or incomplete information may affect system performance.
  • INX Technologies does not guarantee specific delivery rates for automated emails, as delivery depends on recipient email providers and spam filtering policies.
  • Complex automation requirements may require additional consultation and configuration time beyond initial estimates.

4. Maintenance Terms

INX Technologies provides ongoing maintenance for automation systems as part of our managed service model. Maintenance includes:

  • Monitoring of automation workflows for errors and performance issues.
  • Applying updates and patches to maintain system reliability.
  • Troubleshooting and resolving issues reported by the client.
  • Adjusting configurations as needed based on client requests (within the scope of the agreed service).

Maintenance is provided during business hours (Monday – Saturday, 10:00 AM – 6:00 PM IST). Emergency support outside business hours may be available on a case-by-case basis.

5. Liability Limitation

To the maximum extent permitted by applicable law:

  • INX Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our Services.
  • INX Technologies' total liability for any claim arising from our Services shall not exceed the total fees paid by the client for the specific service giving rise to the claim during the twelve (12) months preceding the claim.
  • INX Technologies is not responsible for losses resulting from third-party service outages, changes to third-party APIs, or actions taken by email providers.
  • INX Technologies is not liable for any data loss resulting from client actions, including but not limited to providing incorrect configuration details or revoking necessary access permissions.

6. Service Modification

INX Technologies reserves the right to modify, update, or discontinue any aspect of our Services with reasonable notice to affected clients. Modifications may include:

  • Updates to automation system configurations to improve performance or security.
  • Changes to supported integrations based on third-party service availability.
  • Adjustments to service scope or pricing with advance written notice.

We will make reasonable efforts to notify clients of significant changes at least seven (7) days in advance. Continued use of our Services after modifications constitutes acceptance of the updated Terms.

7. Termination

Either party may terminate the service agreement by providing written notice. Upon termination:

  • INX Technologies will cease all automation services for the client.
  • Client data processed through our systems will be securely deleted within thirty (30) days, unless retention is required by law.
  • Any outstanding fees for services rendered prior to termination remain payable.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our Services shall be subject to the exclusive jurisdiction of the courts in Patna, India.
